Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website and Client Portal of Ngima Wangai & Company Advocates ("the Firm," "we," "us," or "our"). By accessing this website or the Client Portal, you agree to be bound by these Terms. If you do not agree, please discontinue use of the site.

Use of the Website

You agree to use this website only for lawful purposes. You must not attempt to gain unauthorized access to any part of the site or Client Portal, interfere with its proper functioning, introduce malicious code, or use automated means to scrape or harvest content without our prior written consent.

No Attorney-Client Relationship

The content published on this website, including the Practice Areas, Leadership profiles, and any articles or general information, is provided for informational purposes only and does not constitute legal advice. Browsing this website, submitting a message through our Contact page, or communicating with us through this site does not create an attorney-client relationship between you and the Firm or any of its advocates.

An attorney-client relationship is only formed once the Firm has expressly agreed to act for you, typically through a signed engagement letter or an equivalent written confirmation. Until then, please do not send us confidential or sensitive information that you expect to be protected as privileged.

Client Portal Terms

The Client Portal is available only to existing clients of the Firm, subject to the following:

  • Your portal account is created by our administrative team, and you log in using the case number and national ID number provided to you. You are responsible for keeping these credentials confidential and for all activity on your account;
  • You must not attempt to access another client's case, account, or documents;
  • You are responsible for the accuracy and lawfulness of any document you upload to the portal, and you confirm that you have the right to share any document you submit;
  • Once a document you have uploaded has been confirmed as received by our team, it can no longer be edited or deleted; you may upload a new version if a correction is needed; and
  • We may suspend or terminate portal access if we reasonably believe these Terms have been violated, or if your matter with the Firm has concluded.

Reviews and Submitted Content

If you submit a review on our website, you confirm that it reflects your genuine experience and that you have the right to post it. Reviews are published as submitted, without editing of their content by the Firm, except that we reserve the right to remove reviews that we reasonably determine to be spam, fraudulent, abusive, or otherwise in violation of these Terms. Reviews reflect the opinions of individual clients and do not represent the views or guarantees of the Firm regarding future outcomes for any other client.

To limit abuse, review submissions are restricted to one per week per IP address. After submitting a review, you have a one-minute window in which you may edit or delete it; after that window closes, the review becomes permanent and can only be removed by the Firm in accordance with this section.

Intellectual Property

All content on this website, including text, graphics, logos, and the Ngima Wangai & Company Advocates name and mark, is the property of the Firm or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.

Third-Party Links

Our website may link to third-party services, including WhatsApp and our social media profiles. We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of any such service is subject to its own terms and privacy policy.

Disclaimer of Warranties

This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the accuracy, completeness, or availability of the website or its content, and we do not warrant that the site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, the Firm shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of this website or Client Portal. Nothing in these Terms limits any liability that cannot be excluded under the laws of Kenya, including in relation to services actually provided under a signed engagement with the Firm.

Governing Law

These Terms are governed by the laws of Kenya, and any dispute arising from or relating to them shall be subject to the exclusive jurisdiction of the courts of Kenya.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the website after any changes take effect constitutes acceptance of the revised Terms.
